BIO METALWORKING FLUIDS ARE MANUFACTURED FROM HIGH QUALITY NATURAL SEED OILS AND BLENDED WITH SELECT ADDITIVES. AS WITH ALL METALWORKING FLUIDS, GOOD PERSONAL HYGIENE AND CAREFUL HANDLING SHOULD ALWAYS BE PRACTICED. AVOID PROLONGED CONTACT TO SKIN, SPLASHING INTO THE EYES, INGESTION OR INHALING OF VAPOR OR MIST. REFER TO THE MATERIAL SAFETY DATA SHEET FOR FURTHER INFORMATION.

Performance Biolubes, LLC (“PBL”) dedicates substantial efforts in the manufacture and quality assurance testing of its products. The information provided regarding the above subject product (“Product”), including but not limited to such in this Bulletin and any and all other written materials (“Product Information”) is reasonably believed to be complete and accurate. However, PBL has no control over operating conditions during product use and/or storage. The Customer expressly accepts the Product subject to a limited warranty and limited liability:

Limited Warranty. PBL provides a limited warranty that the Product has the qualities as expressly described within the Product Information, subject to variation within industry standards, and that such is fit only for the particular purpose described in the Product Information, and for no other (“off-label”) purposes; PBL expressly disclaims any and all other warranties of any nature, type, and extent, including merchantability and/or fitness for any other particular purpose.

Limited Liability. As an express condition of any transaction to convey the product to the Customer, the Customer, as a sophisticated entity, agrees that the liability of PBL, and that of its employees, officers, distributors, and contractors, for any and all claims, demands, and actions, including but not limited to such under the warranty and any other theory, and inclusive of any and all damages, costs, and attorneys’ fees, is limited to only: (a) refund of the purchase price and costs of shipping, or (b) replacement of the Product, as the Customer shall elect between such alternatives. In the event of any conflict between the terms and conditions of a purchase order and this Bulletin, the terms and conditions of the written purchase order executed by Customer and PBL shall control.
